§ 1089.3 Waiver of right to appeal.

If the state decides not to file an appeal within the time allowed, it gives up its chance to challenge the magistrate's decision. Once that deadline passes without an appeal, the state cannot go back and try to appeal later.

This means the magistrate's original ruling becomes final and locked in. The case moves forward based on that decision, and the state has no more options to fight it through an appeal.
