§ 383 Resubmission of charge.

Here's what this rule means: if a grand jury dismisses a criminal charge, that's not necessarily the end of it. A judge can order the same charge to be brought before a grand jury again.

However, this can't happen on its own. Prosecutors can't just resubmit a dismissed charge whenever they want. A judge has to specifically direct that it happen again.

So there are two ways a dismissed charge can go: it either stays dismissed for good, or a judge steps in and orders a new grand jury to look at it again. Without that judge's order, the charge stays closed and cannot be brought back to a grand jury.
