If a judge turns down the defendant's motion, the defendant has to respond to the charges right away. There's no waiting period or delay allowed at this point.

The defendant has two options for responding. They can file a demurrer, which basically argues that even if everything in the charges is true, it's not actually a crime or there's some legal problem with how the charges were written. Or they can enter a plea, responding directly to whether they're guilty or not guilty of what they're accused of.

The key point here is timing. Once the motion is denied, the case moves forward immediately. The defendant can't sit on their hands or put off dealing with the charges. They have to pick one of these two paths and take action right then.
