§ 509 Demurrer sustained - Defendant discharged or bail exonerated, when.

When a judge sustains a demurrer and decides not to let the case move forward, the defendant gets released from the charges right away. If the person was sitting in jail, they must be let go. If they had posted bail, that bail is canceled and they're no longer bound by it. And if they paid cash instead of using a bail bond, they get that money back.

Basically, this rule protects people from being stuck in limbo. If the court throws out the case and doesn't want prosecutors to try again, the defendant shouldn't keep sitting in jail or keep their bail money tied up. Everything gets wrapped up and returned to normal, as if the case is done.
