§ 764 Application made to court or judge - Notice.

If someone wants to ask the court for something under this rule, they need to give the other side a heads-up first. The request can go to either the court itself or to a judge. Whoever is making the request has to notify the opposing party's lawyer, if they have one, at least five days before the request is made.

This five-day notice period gives the other side time to prepare a response. It stops one party from surprising the other with a sudden request that the other side has no chance to react to. If there's no lawyer on the other side, this notice requirement wouldn't apply in the same way, but if there is one, the five-day window has to be followed.

In short, this rule is about fairness. It makes sure both sides know what's happening in the case and have a fair chance to respond before a judge makes a decision.
