If someone is charged with a lesser crime, but the case involves a more serious offense, the court can later file charges for that bigger crime within one year. This is true even if the jury in the first case was let go without reaching a verdict.

Some people might think being in that first case means they can't be tried again, since that could count as being tried twice for the same thing. But this rule says that's not the case. If the jury was dismissed on the original lesser charge, that doesn't stop prosecutors from filing the more serious charge later. The person can't use "I was already tried for this" as a defense, because the earlier case doesn't count as a final decision on the more serious crime.

In short, walking away from a jury that couldn't reach a verdict on a smaller charge doesn't protect someone from facing a bigger charge tied to the same situation, as long as that bigger charge is filed within a year.
