§ 927.1 Punishment assessed by court.

Sometimes a jury finds someone guilty but can't agree on the punishment, or simply doesn't include a punishment in their verdict. When this happens, the judge steps in to decide the punishment instead of the jury.

The judge will look at the case and determine what the appropriate sentence should be. Once the judge decides on the punishment, they will officially declare it and issue the judgment based on that decision.

This means a defendant's fate isn't left hanging just because the jury couldn't settle on a specific punishment. The judge makes sure the case moves forward and a sentence gets decided, even if the jury only agreed on guilt but not on how severe the punishment should be.
