RULE 1.102 DESIGNATION OF PARTIES

When someone appeals a workers' compensation decision, the rule spells out how the people involved must be labeled in the case paperwork. Anyone who joins together to ask for a review of the decision is called a "petitioner." This applies whether it's one person or several people filing together.

On the other side, the rule requires that the Workers' Compensation Commission (or the Workers' Compensation Court of Existing Claims, depending on which one handled the original case) be included in the appeal. Anyone else who is affected by the decision being challenged must also be part of the appeal. All of these parties are called "respondents."

In short, this rule makes sure everyone with a stake in the outcome is properly included in the appeal, and it gives clear labels to each side so the court and the parties know who is asking for the review and who must respond to it.
