RULE 1.116 COMMENCING APPEALS

If you want to appeal a tribunal's decision, you need to act fast. You have to file a petition in error with the Oklahoma Supreme Court within 30 days of the decision. Missing this deadline can cost you your right to appeal, so mark the date on your calendar as soon as the decision comes out.

When you file, you also need to take care of the costs involved. You can either pay the required filing fees or, if you can't afford them, submit an affidavit in forma pauperis. This is a sworn statement explaining that you don't have the money to pay the standard costs, which allows the court to waive those fees.

If you decide to mail your petition instead of filing it in person, the mailing date counts as your filing date, as long as you follow the mailing rules set out in Rule 1.4(c). This gives you a bit of flexibility, but you still need to make sure your petition is postmarked within that 30 day window.
