RULE 1.89 ADDITIONAL EVIDENCE MAY BE ORDERED AND PREPARATION OF RECORD

When a case involving the Corporation Commission is appealed, the Oklahoma Supreme Court has the power to ask for more evidence if it needs it to fairly decide the case. This can happen either because the Court decides on its own that more evidence is needed, or because one of the parties involved asks for it.

The main reason the Court would do this is to make sure it can properly judge whether someone's rights under the U.S. Constitution or the Oklahoma Constitution were protected. If the existing evidence isn't enough to answer that question, the Court can send the case back to have more evidence collected before making its final decision.

This rule exists so the Supreme Court has all the information it needs to rule fairly, especially when constitutional rights are at stake. It gives the Court flexibility to fill in gaps in the record rather than being stuck with an incomplete picture of what happened.
