sec 11.2 Basic Information for Determining Status of Lands Alloted Under the Act

This rule helps someone checking a property's history figure out whether land that was given out under the General Allotment Act is still held in trust by the federal government, or whether it has become regular private property. It doesn't decide the answer itself. Instead, it gives the person doing the research a starting point and some places to look for answers.

The basic rule of thumb is simple: if there's no recorded fee patent from the United States government on file, the examiner should assume the land is still in trust status. A fee patent is the document that would show the land was released from trust and turned into normal private property.

If the examiner needs more information to confirm this, the rule lists several places to check. These include a Title Status Report from the Bureau of Indian Affairs office that handles that area, other records kept by that same BIA office, any relevant federal laws or amendments that might affect the land's status, and local county or court clerk records. Using these sources together can help build a clearer picture of what has happened to the land over time and whether it remains under federal trust protection.
