sec 24.3 Release by Personal Representative

When someone who holds a mortgage dies, their estate's personal representative (sometimes called an executor or administrator) can sign a release to clear that mortgage from the property records. This works whether the personal representative was appointed by a court in Oklahoma or in any other U.S. state or territory.

To make the release valid, the personal representative needs to file a certified copy of their letters testamentary or letters of administration with the county clerk in the county where the mortgage is recorded. This paperwork proves they are officially authorized to act on behalf of the deceased mortgagee's estate. Once that's filed, the release is good and the mortgage can be cleared from the title.

This rule matters if you're trying to sell or refinance property and find an old mortgage still showing up in the records, especially if the lender named on that mortgage has passed away. It gives a clear path for closing out that debt through the estate's representative instead of leaving the property tangled up in paperwork.
