Rule 4.30 Review of Agency Denial of Motion to Stay

If you asked a state agency to pause (or "stay") its decision while you appeal, and the agency said no, you can ask the court to review that denial. This means the court, not just the agency, gets to look at whether the pause should have been granted.

When you file this request with the court, you need to include certain paperwork. This includes any documents you think the agency looked at when it decided your stay request, the agency's written decision if it gave one, and anything else you think is important for the court to see.

The agency normally gets a certain amount of time to respond to your request. But the court can change that deadline, making it longer or shorter depending on the situation.
