Rule 50 Jury Trial

If your case qualifies for a jury trial under the Oregon Constitution or a state law, you have the right to that jury trial. The court must protect this right and cannot take it away.

This means that once you have a valid claim to a jury trial, the court has to let you use one. Judges cannot decide the case on their own instead of letting a jury hear it, as long as the law gives you that right in the first place. This rule protects a basic part of the legal process: letting regular citizens, not just a judge, decide the facts of a case when the law says you're entitled to that option.
