§ 131.845 Findings

When a judge holds a hearing about whether law enforcement officers are doing their jobs properly, the judge has to make a decision based on the evidence presented. The judge listens to the facts brought up during the hearing and then decides what those facts actually show.

The judge must specifically answer one main question: are the officers being investigated actually enforcing the state's criminal laws the way they're supposed to? The judge can't avoid this question or leave it unanswered. Once the hearing ends, there needs to be a clear finding on whether these officers are doing their duty to uphold and enforce the law.

This process gives a formal, official answer about whether law enforcement in a certain area is working the way it should. It creates a record that can be used to hold officers accountable if they aren't doing their jobs, or to confirm that they are.
