§ 131A.015 Vesting of title to forfeited property

When property gets forfeited in a criminal case, the government's ownership of that property actually starts at an earlier point than most people expect. Under this rule, the forfeiting agency (like a police department or district attorney's office) technically gains ownership the moment the illegal act happens, not when a judge signs off on the forfeiture later.

This matters because it affects who has legal rights to the property during the time between the crime and the final forfeiture decision. For example, if someone uses a car to commit a crime, the government's claim to that car legally begins at that moment, even though the formal forfeiture process and court approval come afterward. Any sale, transfer, or other action involving that property after the illegal conduct occurred could be affected by this rule, since the government's interest is already attached.
