§ 131A.235 Responsive pleading

If you claim you have a legal interest in property that the government is trying to take through forfeiture, you need to respond to the case in writing. This written response follows the same rules used in regular civil court cases in Oregon.

There's one extra step you might need to take. If you haven't already filed a formal claim about your interest in the property under a related rule (ORS 131A.165), you need to attach that claim to your written response. This means you can't just respond to the forfeiture action alone. You also have to spell out exactly what interest you have in the property, unless you already did this earlier in the case.

The main exception to this rule is spelled out in ORS 131A.240, which covers situations where these filing requirements don't apply.
