§ 132.390 When the grand jury may indict

Before a grand jury can charge someone with a crime, they have to look at all the evidence together and ask a simple question: if nobody explained this away or argued against it, would this evidence be enough to convict the person at trial? If the answer is yes, the grand jury can issue an indictment.

This is a fairly low bar compared to what happens at an actual trial. The grand jury is not deciding guilt or innocence. They are only deciding whether there is enough evidence to move forward with charges. They don't need to hear both sides of the story or consider explanations the accused person might give. They just look at what's in front of them and decide if it looks strong enough to potentially lead to a conviction later on.

For someone facing charges, this means the grand jury process is meant to filter out weak or baseless cases, but it is not a full trial. Being indicted does not mean someone is guilty. It just means the grand jury believed the evidence, as presented to them, was serious enough to bring formal charges and let the case proceed to trial, where the full evidence and arguments from both sides will actually be weighed.
