§ 133.220 Who may make arrest

Several different people have the legal power to arrest someone in Oregon, not just police.

A police officer can make an arrest either with a warrant or without one, depending on the situation. Parole and probation officers also have arrest power. They can arrest someone with a warrant, or without one if the person has broken the rules of their probation, parole, or post-prison supervision.

The law also allows regular private citizens to make an arrest in certain situations, though this is less common and usually more limited than what police can do. Federal officers can make arrests too, even in cases handled under Oregon state law.

This rule basically lists out everyone who has legal authority to arrest a person. It matters because if someone is arrested by a person who does not have this authority, the arrest could be challenged as improper.
