§ 133.727 Proceeding under expired order prohibited

If police get a court order to do something like wiretap a phone or track someone, that order only lasts for a certain amount of time. If officers want to keep using it after it expires, they have to go back to the court and get it renewed.

This rule says officers can't keep acting on an order after it has expired if it wasn't renewed. If an officer knows the order expired and uses it anyway, the law treats it as if the officer never had a valid order at all. This means the officer loses the legal protection that order gave them.

There's also a real penalty attached. An officer who knowingly keeps acting under an expired order can be charged under ORS 165.543, which deals with misusing this kind of surveillance authority. In short, this rule stops officers from using outdated permission to justify ongoing surveillance or searches, and it holds them accountable if they try.
