§ 133.793 Penalty for disobedience to ORS 133.787

If a police officer hands over a prisoner to another state before the legal waiting period is up, that officer has broken the law. Oregon requires officers to wait a certain amount of time before handing someone over for extradition, so the person has a chance to challenge it in court if they want to. This waiting period is set out in a related law, ORS 133.787.

If an officer skips this step and hands the person over too soon, the officer can be charged with a Class B misdemeanor. This is a criminal charge, and it means the officer broke a rule meant to protect the rights of the person being extradited. The point of the rule is to make sure people are not rushed out of the state before they get a fair chance to fight the extradition through legal means.
