§ 135.285 Modification of release decision

If something changes after a defendant is released while waiting for their case to be resolved, the court can revisit and change the terms of that release. This might mean changing the conditions the defendant has to follow, or changing the amount of bail or security involved.

The court can make this change on its own, without anyone asking. The district attorney can also ask for a change, and so can the defendant. This gives everyone involved a way to update the release terms if new information comes up or the situation looks different than it did before.

For example, if a defendant breaks a rule of their release, the district attorney might ask the court to make the release stricter. On the other hand, if a defendant has followed all the rules and shown they're not a risk, they might ask the court to ease up on the conditions or lower the bail amount.
