§ 135.560 Order to set aside is no bar to future prosecution

If a judge sets aside an indictment or dismisses charges against you, that does not mean the case is over for good. Prosecutors can usually bring the same charges again later, even after this kind of dismissal.

There is one big exception. If the charges were dismissed because of double jeopardy (meaning you already faced trial or punishment for the same crime), then prosecutors cannot try again. But for any other reason a case gets dismissed or an indictment gets set aside, the door stays open for prosecutors to refile the same charges in the future.

This means a dismissal is often not a final win for someone accused of a crime. It may just be a temporary stop, and the state can come back with the same charges if they fix whatever problem caused the dismissal in the first place.
