§ 135.755 Dismissal on motion of court or district attorney

A judge or the district attorney can decide to stop a criminal case before it's finished, if doing so serves justice. This means the case can be dismissed even if the person hasn't gone to trial, as long as there's a good reason to end it early.

If this happens, the judge has to write down the reasons for dismissing the case. That explanation becomes part of the official court record, so there's a clear account of why the case was dropped.

This rule gives courts and prosecutors some flexibility. Not every case needs to go all the way through the system. Sometimes new information comes up, or continuing the case just doesn't make sense. This rule allows the case to end without a trial, but it requires the reasoning to be documented so there's transparency about the decision.
