§ 135.785 Surrender of custody under ORS 135.775

When someone is locked up in an Oregon prison and another state (or the federal government) needs to bring them to court under the Agreement on Detainers, the prison official in charge has to hand that person over. This happens when the other state has filed the right paperwork and followed the rules of the Agreement on Detainers, which is a system that lets states work together to move prisoners for pending criminal charges.

In simple terms, this rule stops prison officials from refusing to release someone or dragging their feet when another state has a legal claim to bring that person to trial. If the proper detainer request has been made, the prison must comply and turn the person over so the other case can move forward.
