§ 136.435 Admissibility of evidence from felony defendant not informed as required under ORS 135.070

When someone is arrested and charged with a felony, the law requires a judge to inform them of certain rights before moving forward with the case. This includes things like telling the person what they're charged with and making sure they understand their basic legal rights.

If the judge skips this step and doesn't properly inform the defendant, any evidence that comes from that mistake can't be used against the defendant in court. This applies whether the evidence was found directly because of the mistake or came from leads that grew out of it.

The defendant has to speak up and object to keep this evidence out. If they don't raise the issue, the court won't automatically block the evidence on its own. This rule exists to make sure judges follow the proper steps early in a case, and to give defendants a real consequence when that doesn't happen.
