§ 136.645 Codefendant as witness

If you're on trial with someone else and that person was also named in the same charging document (like a shared indictment), they can still testify as a witness at your trial. Being named as a codefendant doesn't automatically stop them from taking the stand.

This matters because it means prosecutors or defense attorneys can't block a codefendant from testifying just by pointing out that they're also charged in the same case. The court will still look at other rules to decide if the testimony makes sense or is allowed, but simply being a codefendant isn't a valid reason to keep someone off the witness stand.
