§ 137.754 Authority of court to modify judgment to comply with ORS 137.750 and 137.752

This rule lets a judge fix a sentence after the fact if it was written incorrectly the first time. Normally, once a court hands down a final judgment, it cannot go back and change it. This rule creates an exception for certain sentencing errors.

The judge can only make this kind of correction if three things are true. First, the original judgment must have been entered on or after December 5, 1996. Second, the crime itself must have happened on or after that same date. Third, the judgment must have failed to follow the rules laid out in ORS 137.750 or 137.752, which deal with conditions for offenders who are found to be sexually violent and dangerous.

In plain terms, this gives courts a way to correct mistakes tied to these specific sentencing laws, even after the case seems closed. It does not give judges broad power to change any sentence they want. It only applies when the original paperwork missed a legal requirement tied to these two specific statutes.
