§ 138.030 Parties designated “appellant” and “respondent”; title of action

When someone appeals a criminal case in Oregon, the two sides get new labels. The person who is appealing is called the "appellant." The other side, the one defending against the appeal, is called the "respondent."

Even though the labels change, the name of the case itself stays the same. So if the case was called State v. Smith at trial, it's still called State v. Smith on appeal. Only the roles of "appellant" and "respondent" get added to show who is doing what in the appeal process.
