§ 147.296 Action for failure to provide notice

If someone gets money from a court judgment, settlement, or other legal deal, they may be required to tell the Department of Justice about it first. This is because the state sometimes has a legal claim to part of that money, similar to a lien on a house. That claim usually applies in cases involving victim compensation payments the state has already made.

If a person skips this required notice, the Department of Justice can take legal action against them directly. The department can still go after the money it would have been entitled to, even though it wasn't told about the payment. In short, failing to give notice doesn't let someone dodge the state's claim. It just means the state may need to sue to collect what it's owed.
