§ 147.438 Habeas corpus proceedings in federal court

If someone challenges their conviction in federal court through a habeas corpus case, and Oregon is involved in that case, the state has to honor the rights of crime victims. Those rights come from a federal law called 18 U.S.C. 3771. This includes things like keeping the victim informed about the case and letting them be heard at certain points in the process.

This rule makes sure that even when a case moves from state court to federal court, victims don't lose the protections they're supposed to have. If the state fails to follow these victim rights, the person affected can seek a fix, but that fix has to come through federal law, not Oregon law. In other words, Oregon courts don't decide how to handle the violation. Federal rules do.

This rule mainly works behind the scenes to make sure Oregon stays consistent in protecting victims, no matter which court system is handling the case.
