§ 40.075 Rule 201(e). Opportunity to be heard

If a judge decides to accept something as fact without requiring proof (this is called "judicial notice"), you have the right to speak up about it. You can ask the judge to explain why they're treating that fact as true, or you can question whether it's actually accurate.

You need to make this request in a timely way, but you don't have to do it before the judge takes judicial notice. If the judge didn't warn you ahead of time that they were going to do this, you can still raise your concerns after the fact. The court just needs to give you a fair chance to be heard on the issue at some point.
