§ 40.130 Rule 310. Conflicting presumptions

Sometimes two legal presumptions point in different directions in the same case. When that happens, the court has to decide which one wins.

The court picks the presumption that makes more sense based on sound policy and logic. Basically, the judge looks at the reasons behind each presumption and goes with the one that has stronger, more convincing support behind it.

If both presumptions are equally strong and there's no clear reason to favor one over the other, then neither one applies. In that situation, the case moves forward without either presumption affecting it, and the facts get decided based on the actual evidence presented instead.
