§ 40.195 Rule 409. Payment of medical and similar expenses

If someone pays for another person's medical bills after an accident, that payment can't be used in court as proof that they caused the accident. The same goes for property damage. If someone pays to fix a fence they may have hit, that payment can't be used to prove they were the one who hit it.

This rule exists to encourage people to help others after an accident without worrying that their kindness will be used against them later. Without this protection, people might hesitate to pay for someone's hospital bill or repair costs out of fear that doing so would make them look guilty in a lawsuit.

So if you paid for someone's medical care or fixed something you damaged, that act of paying cannot be brought up in court as evidence that you were at fault. The other side would need other proof to show you caused the harm.
