§ 40.215 Rule 413. Measures and assessments intended to minimize impact of or plan for natural disaster

If someone gets hurt or property gets damaged during a natural disaster like an earthquake, flood, or wildfire, this rule limits what evidence can be used in court. If a person or organization took steps ahead of time to prepare for the disaster or checked how vulnerable they were to it, that evidence cannot be used to prove they were negligent or did something wrong.

This means if a business or government agency made safety plans or ran risk assessments before a disaster hit, those actions cannot later be used against them in a lawsuit. The idea is to encourage people and organizations to prepare for disasters without worrying that their preparation efforts will be twisted into proof that they knew about a danger and failed to fix it.

So if a hospital ran an earthquake preparedness drill last year, and then people got hurt when an earthquake actually happened, the fact that the drill took place cannot be used in court to argue the hospital was careless. The law wants to remove that fear so more organizations will actually plan ahead instead of avoiding preparation to dodge legal risk.
