§ 40.240 Rule 504-2. Nurse-patient privilege

If you get medical care from a licensed nurse, what you tell them or what they learn while caring for you is protected. In a civil court case, that nurse cannot be forced to testify about your care or share what they learned while treating you, unless you agree to let them.

This protection only covers information the nurse needed in order to properly care for you. It applies specifically to civil cases, like lawsuits between individuals or companies. The point is to let patients speak openly with nurses about their health without worrying that private details will come out in court later.

If you want a nurse to be able to share information about your care in a lawsuit, you can give your consent. Without that consent, the law keeps this information private.
