§ 40.285 Rule 512. Privileged matter disclosed under compulsion or without opportunity to claim privilege

If someone reveals private, protected information, that doesn't automatically mean it can be used against them in court. This rule protects people in two specific situations.

First, if a judge wrongly forces someone to share information that should have been kept private (like attorney-client conversations or doctor-patient records), that forced disclosure can't later be used as evidence against them. The mistake by the court doesn't cost the person their privilege.

Second, if someone reveals protected information without getting a real chance to object or claim their privilege first, that disclosure also can't be used against them. For example, if private information comes out before a person even has the chance to say "wait, that's protected," the law still treats it as protected.

Basically, this rule makes sure people don't lose their legal protections just because of a court error or because they didn't get a fair chance to speak up in time.
