§ 40.295 Rule 514. Effect on existing privileges

This rule says that all privileges people already had under Oregon law keep existing after this evidence code was put in place. It doesn't matter if those privileges came from the Oregon Constitution, from state laws, or from decisions made by Oregon courts. They all stay valid.

The only way one of these privileges goes away is if a specific law (section 98, chapter 892, Oregon Laws 1981) directly canceled it, or if it gets changed or removed later through the proper legal process. In other words, this rule doesn't wipe out any existing legal protections. It just confirms that old privileges stick around unless someone officially changes them.

For someone involved in a court case, this means privileges you may already know about, like attorney-client privilege or doctor-patient privilege, still apply. This evidence code didn't erase those protections. It simply organized the rules around evidence while leaving already established privileges in place.
