§ 40.410 Rule 702. Testimony by experts

When a case involves something complicated that regular people might not understand on their own, like medical issues, engineering problems, or financial details, the court can allow an expert to explain it. This could be a doctor, an engineer, an accountant, or anyone else with real knowledge or experience in that subject.

The expert does not need a fancy degree to qualify. They can be considered an expert because of their job experience, training, education, or skills they have picked up over time. What matters is that they actually know the subject well enough to help the judge or jury understand the evidence.

Unlike regular witnesses, who can only talk about what they personally saw or heard, an expert witness is allowed to give their opinion. For example, a doctor could explain what likely caused an injury, or an accountant could explain whether financial records show a pattern of fraud. This helps the judge or jury make sense of technical information that would otherwise be hard to follow.
