Rule 1.040 Local Rules of Court Not Permitted; Exception

Circuit courts in Oregon can't create their own local rules for how cases are handled. All courts have to follow the same statewide rules instead of making up different ones for their county.

There are only a few narrow exceptions to this. Courts can only make local rules if another specific rule, UTCR 1.030, 1.050, or 1.060, gives them permission to do so. Outside of those exceptions, a circuit court cannot enforce a rule that isn't part of the standard statewide system.

For people involved in a court case, this means the rules should work the same way whether you're in one county or another. You don't have to worry about hidden local rules that only apply in one specific courthouse, unless that court is using one of the few exceptions the law allows.
