Rule 2.120 Affidavits

When you're asked to file an affidavit for a court rule, you don't always have to use a sworn, notarized affidavit. Instead, you can use a written declaration where you state your statement is true under penalty of perjury. This declaration needs to follow the format set out in ORCP 1E.

This option gives you a simpler way to provide the same kind of information without needing to go to a notary. However, if a specific law or another court rule says you must use a formal affidavit, then you still have to follow that requirement.
