Rule 23.030 Removal of Cases from the Oclc

If a judge in the Oregon Complex Litigation Court (OCLC) decides a case doesn't belong there anymore, the judge can't just send it away on their own. First, the judge has to talk it over with the OCLC's managing panel and explain why the case should be removed. The managing panel has to agree before anything happens.

Once the managing panel agrees, they don't just kick the case back either. They have to reach out to the presiding judge (or that judge's designee) at the court that would take the case back. Everyone needs to be on the same page before the case actually moves.

Where the case goes next depends on whether venue (the location where the case is officially handled) ever changed while it was in the OCLC. If venue stayed the same the whole time, the case just goes back to the original circuit court it came from. But if venue was changed at some point, the case goes back to whatever circuit court currently has venue. In that situation, no one needs to file a separate motion asking a judge to formally change venue again. The case simply returns to the court that already has it under the current venue rules.
