Rule 3.060 Defendant in Criminal Trial

In a criminal case, the defendant has to stand up during three key moments in court: arraignment, when entering a plea, and when receiving a sentence. This is the standard expectation in the courtroom.

The only exception is if the judge gives permission for the defendant to remain seated. This might happen for medical reasons, a disability, or some other valid reason. Without that permission, though, standing is required at these points in the case.
