Rule 1038.2 Abolition of Case Stated

Pennsylvania courts no longer allow something called a "case stated." This was an old legal procedure where both sides in a lawsuit would agree on the facts and ask a judge to decide the legal questions based on those agreed facts.

If you are involved in a civil case in Pennsylvania, you cannot use this method to resolve your dispute. You will need to use one of the other procedures allowed under Pennsylvania's current court rules.
