Rule 1058 Trial Without Jury

When someone brings an ejectment case (a lawsuit to remove a person from a property), the judge can hear it alone without a jury. When that happens, the case follows the same procedures as other non-jury trials under Rule 1038.

Rule 1038 sets the standard process for how non-jury trials run in Pennsylvania civil courts. This means the same steps, deadlines, and requirements that apply to other judge-only trials also apply to ejectment cases.
