Rule 1078 Exemption of Property. Preliminary Objection

If you believe your property cannot legally be taken through a replevin action, you must say so right away. You raise this argument through a formal written challenge called a preliminary objection, which is filed early in the case before other steps move forward.

A replevin case is when someone goes to court to get back personal property they claim belongs to them. If you think the property in question is protected from being taken this way, waiting to bring it up later is not allowed. You need to act quickly or you may lose that argument.
