Rule 1148 Counterclaim

If you are being sued, you may have your own claim against the person suing you. Instead of filing a separate lawsuit, you can bring that claim directly in the same case as a counterclaim.

There is one main requirement: your counterclaim must be connected to the same event or situation that the other person is suing you over. For example, if someone sues you over a car accident, you could counterclaim that they were actually the one at fault and caused damage to your vehicle.

This rule saves time and money by letting both sides resolve their disputes in one case rather than two separate lawsuits.
