Rule 1561 Property Capable of Proportionate Division. Award

If a piece of property can be split fairly into separate parts, each person gets the portion that matches their ownership share. For example, if you own 60% of a plot of land and the other person owns 40%, the court will divide the land so each person gets their actual share.

This rule works alongside Rule 1560(a), which covers property that can be divided without losing its value or usefulness. The goal is to give each party what they are actually owed based on their interest in the property, rather than forcing one person to buy out the other.
