Rule 1568 Public Sale

When a private sale of a property falls through or is not approved by the court, the property must be sold another way. The court will decide whether it gets sold at a public sale or through a broader private sale that is open to buyers outside the original case.

A public sale is open to anyone who wants to bid, similar to an auction. A private sale "not confined to the parties" means the seller can look for buyers beyond just the people involved in the lawsuit. Either way, the court stays in charge of how the sale happens.
