Rule 1706 Form of the Answer

When someone files a class action lawsuit, the complaint includes a section called "Class Action Allegations." If the other side does not properly deny the facts stated in that section, those facts are automatically treated as true.

To properly deny these facts, the other side must follow Rule 1029, which requires specific and direct responses to each claim. A vague or general denial will not be enough. If the responding party ignores these allegations or gives a weak response, the court will treat the facts as if the other side agreed with them.
